This website, www.thyva.co (the "Site"), is operated by EVERPROFIT Trading LLC, doing business as THYVA ("THYVA", "we", "us", "our"). By visiting the Site or purchasing from us you agree to these Terms of Service ("Terms"), including the policies referenced here (Privacy Policy, Refund Policy, Shipping Policy, Subscription Policy). If you do not agree, please do not use the Site. We may update these Terms at any time by posting the revised version here; continued use after changes means you accept them. Our store is hosted on Shopify Inc.

1. Eligibility & Account

You must be at least 18 years old to purchase from this Site. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate, current and complete information.

2. Products, Pricing & Availability

All prices are in U.S. dollars. We reserve the right to change prices, discontinue products and limit quantities at any time without notice. We make every effort to display product images, colors and labels accurately; actual packaging may vary. We may refuse or cancel any order, including orders that appear to be placed by resellers or that contain pricing or typographical errors; if your payment has been processed we will refund it.

3. Orders & Payment

By placing an order you authorize us to charge the payment method you provide. Payments are processed by Shopify Payments and other third-party processors; we do not store full card numbers. Sales tax is charged where required by law. Subscription purchases are governed by our Subscription Policy and renew automatically until cancelled.

4. Shipping & Returns

We ship within the United States only. Shipping and delivery are governed by our Shipping Policy; refunds and returns by our Refund Policy, including our 30-Day Money-Back Guarantee.

5. Dietary Supplement Disclaimer

THYVA products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease. Information on this Site is for general educational purposes only and is not medical advice. Consult your physician before use if you are pregnant, nursing, taking medication (including blood thinners), have a medical condition, or are under 18. Do not exceed the recommended dose. Keep out of reach of children. Individual results vary.

6. Reviews & Testimonials

Customer reviews and testimonials reflect individual experiences and are not a guarantee of results. We do not pay for reviews. By submitting a review, photo or video you grant us a non-exclusive, royalty-free, perpetual license to use it in our marketing.

10. Disclaimer of Warranties

The Site and products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, except for the express Money-Back Guarantee in our Refund Policy.

11. Limitation of Liability

To the maximum extent permitted by law, THYVA, EVERPROFIT Trading LLC and their officers, employees and suppliers shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid us for the product giving rise to the claim in the 12 months before the claim. Some states do not allow these limitations, so they may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless THYVA and EVERPROFIT Trading LLC from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@thyva.co and attempt to resolve the dispute informally for 30 days. Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring claims in small-claims court. You and THYVA waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration provision by emailing us within 30 days of your first purchase.

14. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms and the policies referenced here constitute the entire agreement between you and THYVA regarding the Site.
